Terms of sale

§ 1. Seller and contact

The seller of the products and vouchers offered on this website is Elżbieta Cierlak, running unregistered business activity, e-mail: elza.cierlak@gmail.com. These terms set out how orders are placed and fulfilled, how courses and photo sessions are booked, and how the forms and newsletter on the website are used.

§ 2. Ordering

1. You choose products, click "Add to enquiry" and send the form. Sending an enquiry does not yet conclude a contract.
2. I reply by e-mail confirming availability, the total price including delivery, the lead time and payment details.
3. The contract is concluded when you accept the confirmation (by e-mail reply or by payment).
4. For made-to-measure tails you provide the measurements and are responsible for them — I am happy to help you measure.

§ 3. Prices and payment

Prices are in Polish zloty (PLN) and are final prices. For products marked "Price on request" I give the price in my reply to your enquiry. The delivery cost is given in the order confirmation. Payment by bank transfer to the account given in the order confirmation. Payment deadline: 7 days from the confirmation — after that the enquiry expires.

§ 4. Delivery and lead time

Delivery options: Pick up in person at a class, Courier delivery, InPost parcel locker.

Products in stock are shipped within 3 working days of receiving payment. Made-to-measure tails are made within the time given in the order confirmation (usually up to 6 weeks).

§ 5. Right of withdrawal (returns)

1. If you buy as a consumer (or as a sole trader for whom the purchase is not professional), you may withdraw from the contract without giving a reason within 14 days of receiving the product.
2. Just send a statement by e-mail to elza.cierlak@gmail.com — you can use the model form below.
3. Send the product back within 14 days of your statement to the address I will give you by e-mail in reply. You bear the cost of returning it.
4. I refund all payments (including the cheapest delivery option) within 14 days of receiving your statement, using the same payment method. I may withhold the refund until I receive the product.
5. The right of withdrawal does not apply to products made to your specification or clearly personalised — e.g. made-to-measure tails or tails in colours you chose (Art. 38(1)(3) of the Polish Consumer Rights Act).
6. You are liable for any decrease in the product's value resulting from use beyond checking its characteristics (e.g. swimming in the tail).
7. You may withdraw from buying a voucher within 14 days of the contract (order confirmation) as long as the voucher has not been used — I will then refund the full payment.

§ 6. Vouchers and discount codes

A voucher is valid for 12 months from the date of purchase. The date of the class or session is agreed individually with the recipient. A voucher cannot be exchanged for cash.

Discount codes are valid within the period and on the terms stated with the code (discount amount, products, number of uses). You enter the code in the enquiry form or open a link containing the code — the discount is shown in the enquiry summary. What counts is the date the enquiry is sent: if the code was valid then, the discount applies even after the code expires. One code can be used per order. A code assigned to an e-mail address works only in an enquiry sent from that address. A code cannot be exchanged for cash, and the discount does not apply to vouchers unless stated otherwise. A discount shown in the enquiry is confirmed in my reply.

§ 7. Courses and photo sessions

1. You book a course, lesson or session via the contact form, by e-mail or by phone. In my reply I confirm the date, place and price.
2. I reserve the date once the deposit is paid, in the amount and by the deadline given in the booking confirmation. Pool entry tickets are not included in the course price — you pay for them on site according to the venue price list.
3. You can reschedule or cancel a class no later than 48 hours before it starts — I will then move the deposit to a new date or refund it. If you cancel later or do not show up, the deposit is forfeited (Art. 394 of the Polish Civil Code). If I cancel the class (e.g. illness, pool closure, weather for open water), I will offer a new date or refund all payments.
4. Classes are for people who can swim and are in good physical shape. Before the class tell me about any health issues that may matter in the water (e.g. heart conditions, epilepsy, recent injuries, pregnancy). During the class follow my safety instructions and the venue rules.
5. Minors take part with the written consent of a parent or guardian.
6. For a course or session booked for a specific date, the 14-day right of withdrawal does not apply (Art. 38(1)(12) of the Polish Consumer Rights Act — leisure and sports services for a specified date). The cancellation rules above apply instead.

§ 8. Complaints

I am responsible for the conformity of products and services with the contract. If something is wrong, write to elza.cierlak@gmail.com — describe the problem, ideally with photos. I will reply within 14 days.

If a product does not conform to the contract, you may request repair or replacement. If repair and replacement are impossible, were not carried out within a reasonable time or the non-conformity is significant, you may request a price reduction or — for a significant non-conformity — withdraw from the contract.

Consumers may use out-of-court dispute resolution, e.g. help from a municipal or district consumer ombudsman or the regional Trade Inspection office.

§ 9. Services on the website (forms, newsletter)

1. On the website I provide free of charge: the contact form, the product enquiry form and the newsletter (after signing up and confirming by e-mail), and for students — the password-protected "Library".
2. All you need is a device with internet access, an up-to-date browser with JavaScript enabled and an e-mail address.
3. The contact and enquiry forms are one-off services — they end when the message is sent. You can leave the newsletter at any time via the "unsubscribe" link in every message or by writing to elza.cierlak@gmail.com.
4. You must not send unlawful or offensive content or spam through the website.
5. Report complaints about how the website works by e-mail — I will reply within 14 days.

§ 10. Personal data

How personal data is processed is described in the Privacy policy.

§ 11. Final provisions

Contracts are governed by Polish law; this does not limit consumer rights under the law of the consumer's country. Changes to these terms do not apply to orders and bookings made earlier. You can save or print these terms at any time; on request I will send them by e-mail.
